Right of Withdrawal for Online Purchases

Consumers generally have the statutory right to withdraw from a distance contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Products.

However, European consumer legislation provides a number of exceptions to this right.

Exception for Perishable Food Products

The Right of Withdrawal does not apply to Products that are liable to deteriorate or expire rapidly.

shop.hooidammer.com primarily sells cheese and other food products. Due to the nature and limited shelf life of these Products, they cannot be returned after delivery and are therefore excluded from the statutory Right of Withdrawal.

The Right of Withdrawal may also be excluded for sealed Products that are not suitable for return for reasons of health protection or hygiene once the seal has been broken after delivery.

This means that correctly supplied food Products cannot be returned simply because the Consumer has changed their mind, ordered the wrong Product or no longer wishes to keep the order.

Non-Perishable Products

If shop.hooidammer.com offers a non-perishable Product for which no statutory exception applies, the Consumer may exercise the Right of Withdrawal within 14 days after receiving the Product.

To exercise this right, the Consumer must notify the Company by means of a clear statement within the withdrawal period.

After notifying the Company, the Product must be returned within 14 days.

Unless otherwise agreed, the direct costs of returning the Product are borne by the Consumer.

Consumers should handle the Product and its packaging with reasonable care. The Product may only be used to the extent necessary to determine its nature, characteristics and functioning. The Consumer may be liable for any diminished value resulting from handling beyond what is necessary.

Refunds Following a Valid Withdrawal

If the Consumer validly exercises the Right of Withdrawal, the Company will reimburse all payments received for the returned Product.

If the entire order is withdrawn, the standard delivery costs will also be refunded. Additional delivery costs resulting from a delivery method chosen by the Consumer are not refundable.

Refunds will be made no later than 14 days after the Company has received the withdrawal notice.

The Company may withhold reimbursement until the returned Product has been received or until the Consumer has supplied evidence of having returned the Product, whichever occurs first.

Refunds will always be made using the same payment method that was used for the original transaction, unless expressly agreed otherwise.
