Terms and conditions

These Terms & Conditions apply to all consumer purchases made through the webshop shop.hooidammer.com.

1. Definitions

In these Terms & Conditions, the following definitions apply:

Company means Henri Willig Kaas B.V., trading through the webshop shop.hooidammer.com.

Consumer means any natural person acting for purposes outside their trade, business, craft or profession.

Agreement means the distance sales agreement concluded between the Company and the Consumer through the webshop.

Products means all food products and any other goods offered for sale through the webshop.

Webshop means the online store accessible at shop.hooidammer.com.

Right of Withdrawal means the Consumer's statutory right to cancel a distance contract within the applicable period, where such right is not excluded by law.

Day means a calendar day.

3. Applicability

  1. These Terms & Conditions apply to every offer made through the webshop and to every Agreement concluded between the Company and the Consumer.
  2. Before placing an order, these Terms & Conditions are made available electronically in such a way that they can easily be stored by the Consumer.
  3. Any deviation from these Terms & Conditions shall only be valid if agreed upon in writing or electronically.
  4. Nothing in these Terms & Conditions limits any mandatory consumer rights under applicable law.

4. Products and Offers

  1. The Company aims to describe all Products as accurately and completely as possible.
  2. Images displayed on the webshop are intended to provide a realistic representation of the Products. As cheese and other food products are natural products, slight variations in colour, shape, weight, appearance or packaging may occur.
  3. Each Product page includes the selling price together with the main product characteristics. Where applicable, ingredients, allergens, nutritional information, storage advice and other legally required product information are also provided.
  4. Obvious errors, misprints or mistakes in product descriptions or pricing do not bind the Company.
  5. Where an offer is subject to specific conditions or has a limited validity period, this will be clearly indicated.

5. Formation of the Agreement

  1. The Agreement is concluded once the Consumer has successfully placed an order, fulfilled the applicable requirements and received an electronic order confirmation from the Company.
  2. The Consumer is responsible for providing complete and accurate billing, contact and delivery information.
  3. The Company reserves the right to refuse an order or impose additional conditions where there are reasonable grounds to do so, including suspected fraud, abuse, incorrect information or previous payment issues.
  4. If an order cannot be accepted, any payment already received will be refunded.

6. Prices

  1. All prices shown on the webshop include VAT unless stated otherwise.
  2. Delivery charges are clearly displayed before the order is completed.
  3. Prices remain valid for the period indicated on the webshop unless changes are required due to changes in VAT rates or other legal requirements.
  4. The Company may change prices and promotions for future orders at any time.
  5. Discount codes, promotional offers and special campaigns may be subject to additional conditions.

7. Payment

  1. Orders can be paid using the payment methods offered during checkout.
  2. Orders are normally processed only after successful payment.
  3. If payment is refused, reversed or cancelled, the Company is entitled to cancel the order.
  4. Consumers should notify the Company immediately if any payment information is incorrect.
  5. Where payment fraud or unauthorised chargebacks occur, the Company reserves the right to recover any reasonable costs permitted by law.

8. Delivery

  1. The Company exercises the greatest possible care when processing and shipping orders.
  2. Orders are shipped from the Netherlands to the EU countries available during checkout.
  3. The delivery address provided by the Consumer shall be regarded as the place of delivery.
  4. Delivery to PO Box addresses is not possible.
  5. Delivery times shown on the webshop are estimates only. Although every effort is made to deliver within the stated timeframe, exact delivery dates cannot be guaranteed.
  6. Unless otherwise agreed, Products will be delivered no later than 30 days after the Agreement has been concluded.
  7. If delivery is delayed or becomes impossible, the Consumer will be informed as soon as reasonably possible and will have the rights provided under applicable consumer legislation.
  8. Products will never be substituted with substantially different alternatives without the Consumer's consent.

9. Risk During Delivery

  1. The risk of loss or damage remains with the Company until the Products have been delivered to the Consumer or to a person designated by the Consumer.
  2. Where the Consumer authorises the carrier to leave the parcel in a safe place, with neighbours or without a signature, the risk transfers to the Consumer once the parcel has been delivered according to those instructions.
  3. The Consumer is responsible for providing a correct and accessible delivery address and for accepting delivery in a timely manner.
  4. Additional costs resulting from incorrect delivery details, failure to collect a parcel or failure to accept delivery may be charged to the Consumer where legally permitted.

10. Receipt and Storage of Food Products

  1. Consumers should inspect their order immediately upon receipt.
  2. Products must be stored and used in accordance with the storage instructions shown on the packaging and, where applicable, on the webshop.
  3. The Company cannot be held responsible for any deterioration in product quality resulting from incorrect storage, delayed collection or failure to receive the order promptly after delivery.
  4. If a Product is damaged, spoiled, incorrectly supplied or otherwise does not conform to the Agreement, the Consumer should contact webshop@hooidammer.com as soon as possible.

11. Right of Withdrawal

  1. Consumers generally have the statutory right to withdraw from a distance contract within 14 days.
  2. However, this right does not apply where the law provides an exception.
  3. In particular, the Right of Withdrawal is excluded for Products that are liable to deteriorate or expire rapidly.
  4. As shop.hooidammer.com primarily sells cheese and other food products, the statutory Right of Withdrawal does not normally apply.
  5. The Right of Withdrawal may also be excluded for sealed goods that are unsuitable for return for reasons of health protection or hygiene once unsealed after delivery.
  6. Where non-perishable Products are sold for which no legal exception applies, Consumers may exercise their Right of Withdrawal within 14 days of receiving the Products.

12. Refunds

  1. Where a Consumer validly exercises the Right of Withdrawal, the Company will refund all payments relating to the returned Product.
  2. If the entire order is cancelled, the standard delivery costs will also be refunded. Any additional costs resulting from the Consumer selecting a more expensive delivery option will not be refunded.
  3. Refunds will be processed within 14 days after receiving the withdrawal notice. The Company may withhold reimbursement until the returned Product has been received or until the Consumer provides proof of return, whichever occurs first.
  4. Refunds will be made using the original payment method unless otherwise agreed.
  5. Food Products for which the Right of Withdrawal is excluded cannot be refunded simply because the Consumer has changed their mind or dislikes the Product.

13. Conformity and Defective Products

  1. The Company guarantees that the Products conform to the Agreement, the product description and all applicable legal requirements.
  2. Where a Product is damaged, spoiled, incomplete or incorrectly supplied, the Consumer should contact webshop@hooidammer.com.
  3. The Consumer may be asked to provide the order number, photographs and a description of the issue.
  4. Depending on the circumstances, the Company may replace the Product, offer a partial refund, provide a full refund or propose another appropriate solution.
  5. Nothing in these Terms & Conditions affects the Consumer's statutory rights.

14. Complaints

  1. Complaints relating to Products or the Agreement can be submitted via: webshop@hooidammer.com
  2. Consumers are requested to include their order number together with a clear description of the complaint.
  3. Complaints will normally be answered within 14 days after receipt.
  4. If additional investigation is required, the Consumer will receive an acknowledgement together with an indication of the expected response time.

15. Liability

  1. The Company shall not be liable for damage resulting from incorrect use or improper storage of Products after delivery.
  2. The Company shall not be liable for allergic reactions where allergens and ingredients have been correctly declared on the packaging or the webshop.
  3. The Company shall not be liable for delays or failures caused by circumstances beyond its reasonable control, including transport disruptions, natural disasters, strikes, government measures or failures of third-party service providers.
  4. Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

16. Privacy

Personal data are processed in accordance with the Privacy Policy available on shop.hooidammer.com.

17. Governing Law

  1. These Terms & Conditions and all Agreements are governed by Dutch law.
  2. This choice of law does not affect any mandatory consumer protection provisions applicable in the Consumer's country of residence within the European Union.
  3. Any disputes shall be submitted to the competent court as determined by applicable law.

18. Amendments

  1. The Company may amend these Terms & Conditions from time to time.
  2. The version applicable to an order is the version available at the time the order is placed.
  3. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
